Frequently Asked Questions

Can my spouse and children immigrate with me?

Yes, your spouse and unmarried children under 21 are included as derivative beneficiaries on your petition. They will immigrate with you when your priority date becomes current.

What if I divorce while waiting?

If you divorce before obtaining your green card, you may be able to convert to the F1 category (unmarried adult children of citizens), which often has shorter wait times. A new I-130 petition would be needed.

What if my child turns 21 or marries while waiting?

Children who turn 21 may still qualify as derivatives under CSPA. If they marry, they can no longer be derivative beneficiaries and would need their own petition.

How long is the F3 wait time?

F3 has some of the longest wait times. Most countries wait 12-15 years, while Mexico and Philippines can exceed 20-25 years.
